    <Abstract>&lt;p&gt;Enjoining good and forbidding evil is one of the fundamental branches of Islam and a foundational principle of the Islamic Republic of Iran, explicitly recognized in the Constitution and in statutory laws such as the &lt;em&gt;Law on the Protection of Commanders of Good and Forbidders of Evil (2015)&lt;/em&gt;. Despite this legal acknowledgment, the implementation of this religious duty in society faces numerous challenges and ambiguities, primarily stemming from its potential conflict with fundamental individual rights such as dignity, life, property, residence, occupation, and privacy. The purpose of this study is to examine the legal status of enjoining good and forbidding evil, to analyze its deficiencies, and to propose solutions for resolving existing legal ambiguities. The research employs a descriptive–analytical and qualitative approach, with data collected and analyzed from legal documents including the Constitution, the Islamic Penal Code, the &lt;em&gt;Law on the Protection of Commanders of Good and Forbidders of Evil&lt;/em&gt;, authoritative Islamic jurisprudential sources, and relevant scholarly articles. The findings indicate that despite the legislator’s efforts to protect those who perform this duty, concepts such as “individual rights” and “privacy” remain insufficiently defined and can lead to subjective interpretations and potential misuse in the enforcement of this religious obligation. Therefore, revising statutory provisions and clearly delineating exceptions and explicit instances are necessary to ensure both the correct and effective implementation of enjoining good and forbidding evil and the protection of individuals’ rights and human dignity.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;امر به معروف و نهی از منکر یکی از فروع اساسی دین اسلام و از اصول بنیادین نظام جمهوری اسلامی ایران است که در قانون اساسی و قوانین عادی مانند «قانون حمایت از آمران به معروف و ناهیان از منکر مصوب ۱۳۹۴» مورد توجه قرار گرفته است. با وجود این، اجرای این فریضه در جامعه با چالش‌ها و ابهاماتی مواجه است که عمدتاً ناشی از تعارض احتمالی آن با حقوق بنیادین افراد نظیر حیثیت، جان، مال، مسکن، شغل و حریم خصوصی می‌باشد. هدف این پژوهش بررسی جایگاه حقوقی امر به معروف و نهی از منکر، تحلیل نارسایی‌ها و ارائه راهکارهایی برای رفع ابهامات قانونی است&lt;strong&gt;.&lt;/strong&gt; روش تحقیق توصیفی-تحلیلی و کیفی بوده و داده‌ها از طریق مطالعه اسناد حقوقی شامل قانون اساسی، قانون مجازات اسلامی، قانون حمایت از آمران و ناهیان، منابع فقهی معتبر و مقالات علمی جمع‌آوری و تحلیل شده‌اند&lt;strong&gt;.&lt;/strong&gt; نتایج تحقیق نشان می‌دهد که با وجود تلاش قانونگذار برای حمایت از آمران و ناهیان، مفاهیمی مانند «حقوق اشخاص» و «حریم خصوصی» همچنان تعریف شفافی ندارند و می‌توانند منجر به برداشت‌های سلیقه‌ای و سوءاستفاده در اجرای فریضه شوند. بنابراین، بازنگری در مواد قانونی و تعیین موارد استثنا و مصادیق روشن ضروری است تا هم اجرای صحیح و مؤثر امر به معروف و نهی از منکر تضمین شود و هم از تعرض به حقوق و کرامت انسانی افراد جلوگیری گردد.&lt;/p&gt;</OtherAbstract>
