These changes have resulted in families no longer exclusively performing traditional functions such as caregiving, economic support, education, transmission of values, and child protection, with many responsibilities redistributed to external institutions including the state, courts, schools, and counseling services. Family law in Iran and England, while based on different philosophical, religious, and institutional foundations, responds differently to these developments. In Iran, families remain anchored in lawful marriage and Islamic jurisprudence, with substitution of family functions implemented in limited or case-specific ways. In England, the law emphasizes functional responsibilities and child welfare, providing greater flexibility in recognizing diverse family forms and distributing caregiving and supportive roles across institutions. Comparative analysis demonstrates that in both systems, substitution of family functions does not equate to the elimination of family, but rather reflects the redistribution of roles and responsibilities between the family and social institutions. Effective legal and policy responses must balance stability, child and vulnerable individual protection, and adaptability to emerging social realities. Findings indicate that structural transformations of family necessitate precise legal and institutional design, preserving traditional foundations while adequately responding to contemporary challenges.</p> <p>تحولات اجتماعی، اقتصادی و فرهنگی در دهه‌های اخیر ساختارهای خانواده را در سراسر جهان تغییر داده و به ظهور خانواده‌های تک‌والدی، خانواده‌های بازترکیب‌شده، روابط هم‌باشی، خانواده‌های فرزندخوانده و خانواده‌های مبتنی بر فناوری‌های نوین باروری منجر شده است. این تغییرات باعث شده است که نهاد خانواده دیگر تمامی کارکردهای سنتی خود، از جمله مراقبت، حمایت اقتصادی، تربیت، انتقال ارزش‌ها و حفاظت از کودک، را به صورت انحصاری انجام ندهد و بخشی از این کارکردها به نهادهای بیرونی مانند دولت، دادگاه‌ها، مدارس و مراکز مشاوره منتقل شود. حقوق خانواده در ایران و انگلیس، با وجود تفاوت در مبانی فلسفی، دینی و نهادی، واکنش‌های متفاوتی به این تحولات داشته‌اند. در ایران، خانواده همچنان بر محور نکاح مشروع و قواعد فقهی استوار است و جایگزینی کارکردها غالباً به صورت محدود و موردی صورت می‌گیرد، در حالی که در انگلیس، قانون بر عملکرد و مصلحت کودک تأکید دارد و انعطاف بیشتری در شناسایی خانواده‌های نوین و توزیع وظایف مراقبتی و حمایتی میان نهادها دارد. مطالعه تطبیقی نشان می‌دهد که در هر دو نظام، جایگزینی کارکردهای خانواده نه به معنای حذف آن بلکه به معنای توزیع نقش‌ها و مسئولیت‌ها میان خانواده و نهادهای اجتماعی است و ضرورت دارد که سیاست‌گذاری حقوقی با حفظ ثبات، حمایت از کودکان و افراد آسیب‌پذیر و انعطاف در برابر واقعیت‌های اجتماعی نوپدید، توازن ایجاد کند. یافته‌ها نشان می‌دهد که تحولات ساختاری خانواده نیازمند طراحی حقوقی و نهادی دقیق است که هم مبانی سنتی را حفظ کند و هم پاسخگوی چالش‌های معاصر باشد.</p> https://journaliki.com/index.php/journaliki/article/download/513/262
