Journal Article 2024 06 09 <p>The foundation, reinforcement, and continuity of marital life depend on love, affection, mutual understanding, respect, and the recognition and observance of each other's rights. The noble religion of Islam, in order to promote and sustain the environment and structure of the family unit, has established rights for both spouses and, in return, has defined corresponding obligations for them. Based on this, the present study adopts a documentary-analytical method with the aim of conducting a jurisprudential-legal investigation into the engineering of marital relationships across four domains: selection of a manager (head of household), financial rights, sexual rights, and the rule of living together in accordance with custom (maʿrūf) in marital relations. The conducted investigations reveal that individual selfishness and legal shortcomings often lead to seemingly lawful abuses within the legal system governing family, particularly in the rights-based interactions between husband and wife. This study examines the legal nature of such abuses, evaluates methods of prevention and response, and, by emphasizing the jurisprudential and legal basis of the rule of living together in accordance with custom, proposes suitable solutions within the framework of Islamic law and civil jurisprudence.</p> <p>زندگی زناشویی قوام، تحکیم و تداومش، به عشق، دوستی، تفاهم، احترام متقابل و به رسمیت شناختن و رعایت حقوق یکدیگر، است. دین مبین اسلام برای توسعه و تداوم محیط و اجتماع کوچک خانواده، حقوقی را برای هر زن‌وشوهری در نظر گرفته و در قبال این حقوق، تکالیفی را نیز برای آنان معین کرده است، بر این مبنا در این پژوهش با روش اسنادی- تحلیلی و باهدف بازکاوی فقهی- حقوقی، به بررسی مهندسی ارتباط زوجین در چهار حیطه انتخاب مدیر، حقوق مالی، حقوق جنسی و قاعده لزوم معاشرت به معروف در روابط زناشویى پرداخته‌شده است. با توجه به بررسی­های صورت گرفته، خودخواهی­های فردی و ضعف­های حقوقی باعث سوءاستفاده‌های به­ظاهر قانونی در نظام حقوقی خانواده به­ویژه در روابط حقوقی زن و شوهر می­شود. این پژوهش، ماهیت حقوقی این سوءاستفاده‌های را بررسی كرده و نحوه پیشگیری و برخور‌د با آن را مورد ارزیابی قرار داده و با توجه به لزوم معاشرت به معروف که از قواعد حاكم بر روابط زوجین است، در بستر فقهی و حقوقی راهکار متناسب را ارائه داده است.</p> https://journaliki.com/index.php/journaliki/article/download/63/128
